Dispute Resolution &
Arbitration Agreement

By using Ad for Income you agree to resolve any disputes through binding individual arbitration rather than court litigation or class actions.

🤝

Step 1 — Informal Resolution First

Before initiating any arbitration or legal proceeding, you agree to contact Ad for Income at legal@adforincome.com and describe your dispute in writing. We will make a good-faith effort to resolve it within 30 days. Only if we cannot reach an informal resolution may either party initiate arbitration.

Binding Arbitration

Please read carefully — this section affects your legal rights

You and Ad for Income agree that any dispute, claim, or controversy arising out of or relating to these terms, the platform, or any transaction conducted through it — including disputes about the existence, validity, or termination of this agreement — shall be resolved exclusively by final and binding individual arbitration, rather than in court.

📋

Arbitration Administrator

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or by a mutually agreed upon neutral arbitrator.

📍

Location

Arbitration may be conducted in person in Billings, Montana; by telephone; online; or solely on submitted documents, as agreed by the parties.

⚡

Small Claims Exception

Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies and remains in small claims court.

💰

Costs

Ad for Income will pay all AAA filing, administrative, and arbitrator fees for claims totaling less than $10,000, unless the arbitrator finds the claim frivolous.

🔒

Confidentiality

Arbitration proceedings and any awards are confidential and may not be disclosed to any third party except as required by law.

Class Action & Jury Trial Waiver

⚠️ You are waiving the right to a jury trial and to participate in a class action

🚫

No Class Actions

You and Ad for Income each agree that all disputes must be brought in your respective individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

🚫

No Class Arbitrations

Unless mutually agreed, the arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding. If this provision is found unenforceable, the entire arbitration agreement shall be null and void.

🚫

Jury Trial Waiver

To the extent any dispute is not covered by arbitration, both parties waive any right to a jury trial. Disputes not subject to arbitration shall be resolved by a judge sitting without a jury.

Governing Law & Venue

🏔️

State of Montana

This Agreement and any dispute arising out of or related to it — or the use of the platform — shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of law provisions.

For any claims not subject to arbitration (or if the arbitration clause is found unenforceable), both parties consent to the exclusive jurisdiction of the state and federal courts located in Yellowstone County, Montana, and waive any objection to such jurisdiction or venue.

Montana law applies regardless of where you are located or where you access the platform. By using Ad for Income, you consent to the application of Montana law to all disputes.

Right to Opt Out

You may opt out of this arbitration agreement by sending written notice to legal@adforincome.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these terms. Opting out does not affect any other terms of service. If you opt out, disputes shall be subject to the governing law and venue provisions above.

Severability

If any portion of this Dispute Resolution section is found to be unenforceable, the unenforceable portion shall be severed, and the remaining provisions shall continue in full force and effect — except that if the class action waiver is found unenforceable, the entire arbitration agreement shall be void.
